CANCELlATION & REFUNDS POLICY

 

Effective Date: January 31, 2025

 

This Cancellation & Refunds Policy (the “Policy”), dated as of the Effective Date provided above, constitutes a legally binding agreement made between Seattle Pride Hockey Association, Inc. (“SPHA”) and you (“Participant”) and governs cancellations and refunds for all SPHA’s events, programs, leagues, and tournaments offered by SPHA, and the purchase of apparel or merchandise sold by SPHA. SPHA and Participant are each a “Party” and together, the “Parties.” The Parties hereby agree to be bound by this Policy. Please note that the below Policy does not apply to sales, promotions, trial periods, or other offers SPHA may designate from time to time.

 

1.   PROGRAMS

1.1.        SPHA offers the following programs: Pride Skate, Seattle Pride Hockey Training, Pride Current Watch Party (collectively, the “Programs”).

1.2.        The Programs take place on dates designated by SPHA.

1.3.        Other than expressly set forth in this Section 1, SPHA does not offer Participants any Credits, Refunds, carryovers, or the like for Participants that no-show, miss a date, become injured, are suspended by SPHA and/or any neighboring organization within the State of Washington, or are ejected from SPHA for misconduct or other behavior.

1.4.        If SPHA or the hosting facility cancels a Program, SPHA will offer Participant a credit to Participant’s mySPHA account (a “Credit”) or, at Participant’s written request, a pro rata refund (a “Refund”), where such Credit or Refund is equal to the amount the Participant paid for the cancelled Program.

1.5.        Participant may cancel their registration for a Program in one of the following ways:

1.5.1.       By providing written notice at least 30 calendar days prior to the applicable Program start date, in which case SPHA will provide a full Credit, or at Participant’s option a Refund, equal to the amount Participant paid for the cancelled Program.

1.5.2.       Subject to Section 1.5.2.1, by providing written notice at least 15 days prior to the applicable Program start date, in which case SPHA will provide a pro-rata Credit, or at Participant’s option a Refund, equal to 50% of the amount Participant paid for the cancelled Program.

1.5.2.1.      If there is a Replacement Participant (as defined below) available to assume Participant’s spot in the Program at least 15 calendar days before the start date of the applicable Program, SPHA will provide a pro-rata Credit, or at Participant’s option a Refund, equal to the remaining 50% of the amount Participant paid for the cancelled Program after SPHA receives the full payment from the Replacement Participant for the applicable Program.

1.5.2.2.        For purposes of the Policy, “Replacement Participant” means (i) an individual that, on the cancellation date, is on a waitlist maintained by SPHA for the Program and such individual agrees to assume Participant’s place in the Program, or (ii) an individual identified by Participant that is available to assume Participant’s spot in the Program. An individual’s status as a Replacement Participant is subject to SPHA’s approval, which will be granted in SPHA’s sole discretion. For the avoidance of doubt, if no Replacement Participants are available for the applicable Program, Participant will not be entitled to a Refund or Credit of the remaining 50% of fees for the Program under Section 1.5.2.1.

1.6.        Notwithstanding anything to the contrary in this Section 1, no Refunds or Credits will be granted beginning 14 calendar days prior to the start date of the applicable Program, even if a Replacement Participant is available. The registration payment will be retained in full by SPHA as a cancellation fee.

 

2.   TOURNAMENTS

2.1.        SPHA currently offers the following tournaments: Seattle Pride Classic, Frozen Pride Classic, traveling teams (Team Seattle) & several associated functions (collectively, the “Tournaments”).

2.2.        Tournaments may be either free agent, individual-based tournaments (e.g., Seattle Pride Classic) (“Free Agent Tournaments”) or team-based tournaments (e.g., Frozen Pride Classic, Team Seattle or any Travel Team) (“Team Tournaments”).

2.3.              Free Agent Tournaments

2.3.1.         Other than expressly set forth in this Section 2.3, SPHA does not offer Participants any Credits, Refunds, carryovers, or the like for Participants that no-show, miss a date, become injured, are suspended by SPHA and/or any neighboring organization within the State of Washington, or are ejected from SPHA for misconduct or other behavior.

2.3.2.         If SPHA or the hosting facility cancels a Free Agent Tournament, SPHA will offer Participant a Credit or, at Participant’s written request, a pro rata Refund, where such Credit or Refund is equal to the amount the Participant paid for the cancelled Free Agent Tournament.

2.3.3.         If there is a Replacement Participant available to assume Participant’s spot in the Free Agent Tournament, Participant may cancel their registration for the Free Agent Tournament in one of the following ways:

2.3.3.1.        By providing written notice at least 90 calendar days prior to the applicable Free Agent Tournament start date, in which case SPHA will provide a full Credit, or at Participant’s option a Refund, equal to the amount Participant paid for the cancelled Individual Tournament

2.3.3.2.        By providing written notice at least 89 calendar days prior to the applicable Free Agent Tournament start date and up to 61 calendar days prior to the applicable Free Agent Tournament start date, in which case SPHA will provide a pro-rata Credit, or at Participant’s option a Refund, equal to 50% of the amount Participant paid for the cancelled Free Agent Tournament. SPHA will retain the other 50% as a cancellation fee.

2.3.3.3.        Notwithstanding anything to the contrary in this Section 2.3, no Refunds or Credits will be granted beginning 60 calendar days prior to the start date of the applicable Free Agent Tournament, even if a Replacement Participant is available. The registration payment will be retained in full by SPHA as a cancellation fee.

2.4.              Team Tournaments

2.4.1.           Registration (excluding any team pre-registration deposits) for any Team Tournament becomes fully non-refundable at time of registration, regardless of reason. ALL SALES ARE FINAL.

2.4.2.           Other than expressly set forth in this Section 2.4, SPHA does not offer Participants any Credits, Refunds, carryovers, or the like for Participants that no-show, miss a date, become injured, are suspended by SPHA and/or any neighboring organization within the State of Washington, or are ejected from SPHA for misconduct or other behavior.

2.4.3.         If SPHA or the hosting facility cancels a Team Tournament, SPHA will offer Participant a Credit or, at Participant’s written request, a pro rata Refund, where such Credit or Refund is equal to the amount the Participant paid for the cancelled Team Tournament.

2.4.4.         For the avoidance of doubt, no Refunds or Credits will be granted for Team Tournament deposits after Participant’s team is accepted to the Team Tournament, including even if there is a team that could assume Participant’s withdrawing team’s place in the applicable Team Tournament. The deposit payment, and any Participant payments made towards that team, if applicable, will be retained in full by SPHA as a cancellation fee.

2.4.5.         Once a Participant registers and submits payment to their team for a Team Tournament, there will be no Credit or Refund available, even if there is another Participant available to assume Participant’s place. ALL SALES ARE FINAL. We encourage Participant to work with their respective Team Captain on options.

2.4.6.         For travel team tournaments (i.e., Team Seattle or SPHA sends a team to another city), once a Participant registers and submits payment, there will be no Credit or Refund available, even if there is another Participant available to assume Participant’s place. ALL SALES ARE FINAL.

 

3.   SEATTLE PRIDE HOCKEY LEAGUE

3.1.              Registration for the Seattle Pride Hockey League (“SPHL”) becomes fully non-refundable at time of registration, regardless of reason. ALL SALES ARE FINAL.

3.2.              Other than expressly set forth in this Section 3, SPHA does not offer Participants any Credits, Refunds, carryovers, or the like for Participants that no-show, cancel, miss a SPHL game, become injured, are suspended by SPHL and/or any neighboring league within the State of Washington, or are ejected from SPHL for misconduct or other behavior.

3.3.              If SPHA cancels one or more games in the applicable season, then SPHA, in its sole discretion, will offer Participant: (a) a Credit equal to the amount the Participant paid for the cancelled game(s), or (b) make up games at the end of the season. If a makeup game is scheduled, SPHA is not obligated to provide any Credit or Refunds for absent Participants.

3.4.              When Participant initially enters the SPHL, Participant will pay a jersey and socks deposit as stipulated by SPHA (the “Uniform Deposit”). Once the season concludes, and all items are returned ((1) jersey + (1) pair of socks) in a fair and reasonable condition, the Uniform Deposit will be credited to the Participant’s “mySPHA Account” for use towards the next season. Participant may request a Refund of the Uniform Deposit up to 30 days after completion of the applicable SPHL season.

 

4.   APPAREL & MERCHANDISE

4.1.              SPHA may offer apparel and merchandise for sale (collectively, “Products”).

4.2.              All Products that Participant purchases from SPHA, whether online or in-person, are not eligible for returns, exchanges, or refunds unless there is a manufacturing defect or customization error through fault of SPHA. Contact SPHA to inquire about a manufacturing defect/error replacement. ALL SALES ARE FINAL.

4.3.              Only Products that have been purchased directly from SPHA are governed by this Policy. Participant must request a refund or return for any apparel, merchandise, or other products purchased through third-party retailers, including SPHA’s vendors, in accordance with that retailer’s respective returns and refunds policy.

 

5.   ISSUING OF REFUNDS OR CREDITS

5.1.              If SPHA grants Participant a Refund pursuant to this Policy, SPHA will provide such Refund in the form of either, in SPHA’s sole discretion, a check mailed to Participant’s billing address on record or a refund to Participant’s credit card associated with Participant’s account. If SPHA grants Participant a Credit pursuant to this Policy, such Credit will be added to Participant’s “mySPHA Account” where it will be eligible for use within 540 calendar days from the day SPHA grants such Credit. If Participant does not use the Credit within the 540 calendar days, then the Credit expires, and Participant may not seek further Refund or Credit. Participants may view the number of days remaining until the applicable Credit expires through the Participant’s mySPHA Account in their Dashboard. SPHA is not obligated to provide electronic and/or written communications of upcoming expiration dates, except as applicable by local law.

6.   ADDITIONAL POLICIES

6.1.            Participant’s participation in Programs, Tournaments, or SPHL is subject to the rules, policies, and additional terms and conditions available on SPHA’s website (“SPHA Terms”), including the Participant Conduct Policy, Privacy Policy, Terms & Conditions, League Guidelines & Supplemental Rules, Player Discipline Guidance, and any program-specific rules (i.e., Tournament Rules, Game Formats) that SPHA may provide to Participant from time to time. Participants are expected to review all applicable SPHA Terms prior to making any purchases or participating in any Programs, Tournaments, and/or SPHL hosted or organized by SPHA.

6.2.            Optional registration insurance is available for purchase during the registration process. Registration insurance, powered by Vertical Insure, helps protect the Participant’s registration fee(s) in the event of unforeseen circumstances, such as injury, illness, or other qualifying events that prevent the Participant from participating in the Program, Tournament and/or SPHL. If registration insurance is purchased for one or more Programs, Tournaments and/or the SPHL, all claims and reimbursements will be handled directly by the insurance provider in accordance with their terms and conditions. The Participant is only eligible for coverage for the Program, Tournament and/or SPHL for which coverage was acquired. SPHA will not be responsible for any disputes or reimbursement claims related to registration insurance – Participant must work directly with Vertical Insure.
